El nuevo tratamiento legal de las enfermedades profesionales en comparación con lo derogado y con la recomendación europea sobre el tema

Abstract

[ES] Los avances producidos en los procesos industriales, la introducción de nuevos elementos y sustancias, el progreso en el ámbito científico y la necesidad de ajustarse a lasrecomendaciones europeas han desembocado en la aprobación del nuevo Real Decreto 1299/2006 de enfermedades profesionales. Conocer y manejar de forma adecuada la lista deenfermedades profesionales vigente es paso indispensable para proceder a declarar todas y cada una de estas enfermedades. Nuestro trabajo se centra en el análisis de la estructura y los cambios que muestra el nuevo cuadro respecto al ya derogado y comparación con las recomendaciones europeas acerca del tema La infradeclaración de EP a la que hemos estado asistiendo podría explicarse en parte por la vigencia hasta hace poco de una lista obsoleta. La reciente publicación del nuevo cuadro de EP ha generado muchas expectativas aunque no faltan opiniones críticas que ponen en duda su eficacia enla consecución del objetivo de subsanar esta infradeclaración. En general el nuevo Real Decreto se ajusta a lasRecomendaciones Europeas y aporta importantes cambios estructurales y de contenido, ajustándose a un modelo mixto. Si bien carece del enfoque preventivo que incentivaba la Unión Europea y deja a un lado las enfermedades por riesgos psicosociales.[EN] The advances produced in the industrial processes, introduction of new elements and substances, progress in the scientific scope and the need to harmonize the national regulation to the European recommendations have ended at the approval of the new Real Decree 1299/2006 of professional diseases. To know and to handle in a suitable way the effective professional diseases list it is an indispensable step in order to notify all and each one of these diseases. Our study is focused in the analysis of the structure and the changes that the new list shows with respect to the precedent one and the comparison with the European recommendation concerning this subjet.The infra- notification of professional diseases,we have been attending, could be explained, partly, by the use, of a obsolete list, until recently.The recent publication of the new list has generated many expectations, although there are opinions that put in doubt its effectiveness in the attainment of the objective to correct this infra notification. In general, the new Real Decree adjust to theEuropean recommendation and include important changes at bough levels: structure and contents,adjusting to a mixed model. Although its preventiveapproaches lacks , that was stimulated from the European Union. Nevertheless the new regulationleaves to a side the diseases by psycho-social risks atworkplace.
