La Agencia de Evaluación de Tecnologías Sanitarias se crea en 1994 (RD 1415/1994) encuadrada en el Instituto de Salud "Carlos III", para atender las necesidades consultivas del Sistema Nacional de Salud en relación con la definición de su Política de Prestaciones Sanitarias. Esta labor general de apoyo a los procedimientos de decisión sobre prestaciones sanitarias se consolida y concreta por la Ley 16/2003, de 28 de mayo, de Cohesión y Calidad del Sistema Nacional de Salud, que vincula expresamente la AETS al procedimiento de actualización de la Cartera de Servicios. Debido a la naturaleza y ámbito de tales actividades, la AETS ha de mantener estricta vinculación funcional con la Dirección General de Cohesión del SNS y Alta Inspección, complementaria de su adscripción orgánica a la Subdirección General de Evaluación y Fomento de la Investigación, del Instituto de Salud Carlos III, según su Estatuto modificado por el R.D. 590/2005 de 20 de mayo.
